FAQs

Was George Shiras Jr. the deciding vote in the 1895 income tax case?

He was widely blamed for the 1895 ruling against the income tax, but the blame was incorrect.

Shiras became notorious as the justice whose vote in 1895 torpedoed the new federal income tax, but he was incorrectly blamed for that decision. The decision ultimately led to the ratification of the Sixteenth Amendment in 1913.
