Supreme Court of Bangladesh

National Supreme Courts (Last Resort)

The Supreme Court of Bangladesh is the highest court of the People's Republic of Bangladesh. Article 94 of the Constitution establishes it as a single Supreme Court made up of two divisions, the Appellate Division and the High Court Division. It is headed by the Chief Justice of Bangladesh, who sits only in the Appellate Division together with the judges appointed to that division, while the remaining judges sit only in the High Court Division. The Chief Justice is appointed by the President, and the other judges are appointed by the President after consultation with the Chief Justice. The permanent seat of the court is in the capital, which the Constitution names as Dhaka, although the High Court Division may sit at other places that the Chief Justice appoints with the approval of the President. The High Court Division has the original, appellate and other powers given to it by the Constitution or by law, and it may order that fundamental rights be enforced. The Appellate Division hears appeals from the High Court Division, as of right in cases that raise a substantial question about interpreting the Constitution or that involve a death sentence or life imprisonment, and otherwise by leave.
