Supreme Court of Togo

National Supreme Courts (Last Resort)

The Supreme Court of Togo was instituted by Law No 61-26 of 26 August 1961, whose first article created a Supreme Court with its seat at Lomé and jurisdiction over the whole territory of the Republic. The member page of the association of francophone supreme courts describes it, under article 120 of the Constitution of 14 October 1992, as the highest court of the State in judicial and administrative matters, a single court sitting in Lomé, whose task is to see that lower courts apply the rule of law and which rules on appeals against judgments of the courts of appeal and on final-instance judgments of the tribunals. Its constitutional and financial matters were taken from it in 1997 and 1998, when the Constitutional Court and the Court of Accounts were created, and since 17 July 2008 it has occupied former villas of the Council of the Entente. The 2024 Constitution now names a Court of Cassation as the supreme court of the judicial order and a Council of State as the supreme court of the administrative order. Abdoulaye Bawa Yaya has presided over it since 14 December 2020, according to that member page.
