The Court of Cassation of Togo is named by article 58 of the 2024 Constitution as the supreme court of the judicial order, while the Council of State is the supreme court of the administrative order. The Constitution organizes the courts of Togo in two separate orders, the judicial and the administrative, and leaves their composition, organization, powers and functioning, with the procedure applicable before them, to an organic law. Its sitting magistrates are irremovable under article 61, and three of them sit among the fifteen judges of the Court of Justice of the Republic, one of whom presides over that court.
