The Court of Cassation is the head of the order of civil and military courts and tribunals of the Democratic Republic of the Congo, which the Constitution places under its control, and it hears appeals in cassation against judgments given in last resort by those courts. It also decides in first and last resort on offences committed by listed officials, including its own magistrates. It took over from the Supreme Court of Justice, which exercised its attributions until the installation of the Constitutional Court, the Council of State and the Court of Cassation. Elie-Leon Ndomba Kabeya took over as First President in Kinshasa on 1 September 2023.

An order of judicial jurisdictions is instituted, composed of the civil and military courts and tribunals placed under the control of the Court of Cassation.

Without prejudice to the other competences which are assigned to it by this Constitution or by the laws of the Republic, the Court of Cassation takes cognizance of the appeals in cassation brought against the orders and judgments rendered in last resort by the civil and military courts and tribunals.
