The Constitutional Court of Guatemala, called the Court of Constitutionality in the Constitution, is a permanent tribunal with exclusive jurisdiction whose essential function is the defense of the constitutional order. It acts collegially and independently of the other organs of the State. Five titular magistrates sit on it, each with a substitute, rising to seven when it hears challenges against the Supreme Court of Justice, Congress or the President or Vice President. They serve five years and are appointed one each by the Supreme Court, Congress, the President in the Council of Ministers, the University of San Carlos and the College of Attorneys. The presidency rotates yearly among the titular magistrates, from the eldest in descending order of age.
