Constitution of Serbia

The Constitution of the Republic of Serbia, also known as the Saint Demetrius Day Constitution, became effective on 8 November 2006, replacing the 1990 constitution after Montenegro's 2006 secession dissolved the state union of Serbia and Montenegro. The National Assembly adopted the text on 30 September 2006 and a constitutional referendum held on 28 and 29 October 2006 returned 53 percent approval. Its preamble and ten chapters of 206 articles establish Serbia as a unitary parliamentary constitutional republic with a unicameral National Assembly, a dual executive of President and Prime Minister, and a Supreme Court, and the original document banned capital punishment and human cloning, granted the National Bank independence and established an ombudsman office. A further referendum on 16 January 2022 approved judicial reforms aligning Serbia with European Union standards, reducing the National Assembly's role in judicial appointments in favor of the High Judicial Council, with the amendments finalized on 9 February 2022.
