Anton Menger

Civil Law Scholars and Codifiers

Anton Menger von Wolfensgrün was an Austrian legal theorist and social philosopher, born in 1841 in Galicia and died in 1906 in Rome. He taught civil procedural law at the University of Vienna from 1874 to 1899, serving as vice chancellor from 1895 to 1896, and was the brother of the economist Carl Menger. In his 1886 work The Right to the Whole Produce of Labor he argued that law is fundamentally a gauge of social power relations rather than an expression of natural law, grounding socialist theory in legal analysis in a way that drew responses from Friedrich Engels and Karl Kautsky.

FAQs

How did Anton Menger's view of law differ from natural law and from Marx?

Menger rejected natural law and treated law as a gauge of societal power relations.

Menger dismissed natural law as the basis of positive law. He argued instead that the backbone of law was merely a gauge of societal power relations. His legal interests are described as different from those of Karl Marx and Friedrich Engels in how they treated theoretical legal questions, and Engels and Karl Kautsky both tried to grapple with his 1886 attacks on Marx's Das Kapital and his project of grounding socialism in legal theory.
