Mudawana

Religious Law Systems

The Mudawana, short for mudawwanat al ahwal ash shakhsiyyah, is the personal status code, also called the family code, governing matters of marriage, polygamy, divorce, inheritance, and child custody in Moroccan law. It was originally grounded in the Maliki school of Sunni Islamic jurisprudence and was formally codified into state law after Morocco gained independence from France in 1956. Its most significant revision, passed by the Moroccan parliament in 2004, was praised by human rights advocates for advancing rights for women and gender equality within an Islamic legal framework, while still operating inside the same religious jurisprudential tradition the code originally codified. The Mudawana illustrates how a modern national legal system can codify and progressively reform rules drawn from a religious legal tradition rather than replacing that tradition outright.
