FAQs

Why is Garfield Barwick remembered for the 1975 constitutional crisis?

He advised Governor-General Sir John Kerr on dismissing the Whitlam government while serving as chief justice.

In 1975, during the parliamentary deadlock, Barwick was chief justice when he agreed to give written advice to Governor-General Sir John Kerr on whether the governor-general had the authority to dismiss the Whitlam government on the basis of its failure to secure supply. The Australian Dictionary of Biography says that this decision would ultimately overshadow his legacies as an advocate or jurist.
