Why did Ernst Freund's approach to administrative law have little influence on later scholars?
His 1928 book made little impression because scholars followed Felix Frankfurter instead.
Freund's major publication for the Commonwealth Fund, Administrative Powers over Persons and Property (1928), made little impression on scholars of administrative law, who took their lead from Felix Frankfurter. The fund had paired Freund with Frankfurter, who celebrated the enlightened discretion of administrators.
