Carlos Santiago Nino was an Argentine legal, moral and political philosopher who lived from 1943 to 1993. He studied law at the University of Buenos Aires and earned a doctorate at Oxford in 1977 under John Finnis and Tony Honoré, beginning his career in traditional jurisprudence before turning to moral and political philosophy. In the early 1980s he served as a personal adviser to President Raul Alfonsin and coordinated a committee on democratic reform. Nino developed an epistemic justification of deliberative democracy and a constructivist ethical theory built on three principles, autonomy, inviolability and dignity, and he proposed a consensual theory of punishment blending retributive and utilitarian reasoning; he died in 1993 during a trip to La Paz to advise on constitutional reform.

How did Carlos Nino's theory of punishment relate to his theory of deliberative democracy?
His penal theory came first and stayed largely untouched by his later democratic theory; he never fully reconciled them.
Nino developed his consensual theory of punishment in England during his doctoral studies, before the democratic transition in Argentina turned his work toward democracy. Later scholarship notes that his penal theory stayed largely untouched by his deliberative and epistemic conception of democracy, even though that conception reshaped his views on other topics such as the origin of rights and the role of judges. Nino had no chance to revise his penal work fully in light of his democratic theory, so the link between the two remains something later writers have tried to work out.

His need to provide a liberal justification for criminal law practice thus lead him to moral philosophy, and to the development of an original "consensual" theory of punishment which combined the merits of the retributive and utilitarian (see deterrence) varieties while avoiding their respective difficulties.
