How was Justice Stephen Johnson Field connected to the case In re Neagle?
His bodyguard shot a man who tried to kill him in 1889, and the Court upheld the bodyguard in In re Neagle.
In 1889 David Terry, whom Field had ruled against as a circuit judge in a divorce case and sent to jail for contempt of court, attempted to kill Field near Stockton, California. Terry was instead shot dead by Field's bodyguard, United States Marshal David B. Neagle. The Supreme Court took up the legal issues in the 1890 habeas corpus case In re Neagle and ruled that the Attorney General had authority to appoint marshals as bodyguards to Supreme Court justices and that Neagle had acted within the scope of his authority. Field recused himself from the case.
