Hermann Heller (1891 to 1933) was a German legal scholar and political theorist of the Weimar era, born in Teschen in Austrian Silesia. Working within the non Marxist wing of Germany Social Democratic Party, he argued in his unfinished Staatslehre that ordinary social and political stability, not states of emergency, is what defines sovereignty, a position developed against Carl Schmitt theories. He fled Nazi Germany for Spain, where he died in Madrid in 1933, and is credited with originating the term authoritarian liberalism.
