The Sikkim High Court is the high court of the Indian state of Sikkim and has its seat at Gangtok, the state capital. Its history reaches back to 1955, when the High Court of Judicature (Jurisdiction and Powers) Proclamation was issued to establish a high court in Sikkim. When Sikkim merged with India as its 22nd state, Article 371F of the Constitution of India provided that the court functioning immediately before the merger became the High Court for the State of Sikkim, on the same footing as the other high courts of the country, and the court was established in its present form in 1975. With a sanctioned strength of only three judges it is the smallest high court in India. Appeals from its decisions lie to the Supreme Court of India, and its judges must retire at the age of 62.
