The Supreme Court of The Gambia was established under section 125 of the Constitution, which was approved by referendum in August 1996 and took effect on 16 January 1997, and which required the court within eighteen months. It consists of the Chief Justice and not fewer than four other Justices of the Supreme Court, together with a Judge of the Court of Appeal whom the Chief Justice selects to sit in a particular matter. Under section 126 it is the final court of appeal for The Gambia, and under section 127 it has exclusive original jurisdiction over the interpretation or enforcement of the Constitution, over whether a law was made in excess of the powers of the National Assembly, and over disputes about the election of the President or members of the National Assembly. The Supreme Court building stands beside the Law Courts complex in Banjul and was officially opened on 5 December 1999.
