The Supreme Court of Mauritius is headed by the Chief Justice, who is appointed by the President acting after consultation with the Prime Minister. To be qualified for appointment as a Judge of the Supreme Court a person must be, and have been for at least five years, a barrister entitled to practise before the Supreme Court. When the holder of the office of Senior Puisne Judge cannot perform its functions, the President, acting on the advice of the Chief Justice, may appoint one of the Judges of the Supreme Court to act in it. In certain constitutional proceedings the determination of the Supreme Court is not subject to appeal, except that an appeal lies to the Judicial Committee in such cases as Parliament prescribes.
