The Nauru Court of Appeal is provided for by article 57 of the Constitution, with jurisdiction and powers to hear and determine appeals on all decisions or judgments of the Supreme Court, though there is no appeal from the Court of Disputed Returns. The Justices of Appeal are appointed by the President in consultation with the Chief Justice, and the Chief Justice is by virtue of office a Justice of Appeal who presides as the President of the Court of Appeal. A Justice of Appeal must be qualified to be a judge of the Supreme Court and have been so qualified for at least five years. The World Factbook archive records that in 2017 Nauru revoked the 1976 High Court Appeals Act, which had allowed appeals beyond the Nauruan Supreme Court, and that in 2018 the government formed its own appeals court.
