The Court of Appeal of Vanuatu is provided for by article 50 of the Constitution, under which Parliament provides for appeals from the original jurisdiction of the Supreme Court and may provide for appeals from its appellate jurisdiction to a Court of Appeal constituted by two or more judges of the Supreme Court sitting together. The World Factbook archive likewise says that the Court of Appeal consists of two or more judges of the Supreme Court designated by the chief justice, and lists it before the Supreme Court, whose chief justice sits with six puisne judges, three local and three expatriate. Article 51 allows persons knowledgeable in custom to sit with the judges of the Supreme Court or the Court of Appeal. The Constitution took effect on 30 July 1980 at independence, and the legal system is a mixed one of English common law, French law and customary law.
