Local people's court

Trial and First-Instance Courts

A local people's court is the first instance level of China's court system under the Organic Law of the People's Courts, which divides the country's courts into high people's courts, intermediate people's courts and primary people's courts. The institution traces back to the 1940s and 1950s, when village level people's courts doubled as assemblies where peasants voiced grievances against landlords in so called speak bitterness meetings, gatherings scholars have compared to kangaroo courts because they were often organized by Communist activists to denounce landlords. The Organic Law of the People's Courts of the People's Republic of China, first enacted in 1954, was re-adopted by the Fifth National People's Congress on July 1, 1979 after the Cultural Revolution and later amended by the Standing Committee on September 2, 1983; the law sets out a judicial framework of the Supreme People's Court, local people's courts and specialized courts in three chapters and 41 articles.
