Trial court

A trial court, also called a court of first instance, is the court in which a case is initially heard, exercising original jurisdiction in which trials take place: evidence and testimony are presented under formal rules of evidence, and the court determines the facts of the dispute and applies the relevant law to reach a decision. In many common law jurisdictions a jury serves as the finder of fact while the presiding judge rules on questions of law, and a decision reached at trial can generally be appealed to a higher appellate court, which typically reviews legal issues rather than re-hearing the underlying evidence.
