Human Rights Act 1998

Civil Rights, Equality and Human Rights Acts

The Human Rights Act 1998 (c. 42) is an act of the Parliament of the United Kingdom that received royal assent on 9 November 1998 and came into force on 2 October 2000, incorporating the rights contained in the European Convention on Human Rights into United Kingdom domestic law. It makes it unlawful for a public body to act incompatibly with a Convention right unless primary legislation leaves it no other choice, and it lets a person seek a remedy for a breach of a Convention right in a UK court without first having to petition the European Court of Human Rights in Strasbourg. Section 21(5) of the act, which took effect on royal assent, completed the abolition of the death penalty in the United Kingdom.
