All Civil and Common Law Hybrid Systems

A civil and common law hybrid system is a national legal order built from both major Western legal traditions at once rather than choosing one. Typically the private law core, contracts, property, torts, comes from a codified civil law source (often French, Roman-Dutch, or Spanish colonial inheritance), while public law, criminal procedure, or the higher appellate courts follow English common law method, precedent-based reasoning layered on top of or beside the code. The mixture usually traces to a specific colonial or political handover: a territory ceded from one imperial power to another, or a federation combining a formerly civil law province with a common law majority. Quebec within Canada, Louisiana within the United States, Scotland within the United Kingdom, and South Africa's Roman-Dutch and English blend are the classic cases; several African and Indian Ocean states inherited the same layered structure from sequential colonization. Comparative law scholarship treats these as a third family in their own right rather than a transitional or incomplete version of either parent tradition, because the blend is stable and long-standing rather than a system still converging on one model.
