Ahmad Baba al-Timbukti

Legal Philosophy and Jurisprudence

Ahmad Baba al-Timbukti, whose full name is rendered Abu al-Abbas Ahmad ibn Ahmad al-Massufi al-Timbukti, was a Maliki Islamic jurist of Sanhaja Berber heritage, born on October 26, 1556, in Araouane in present-day Mali, and died on April 22, 1627, in Timbuktu. A prolific author credited with more than forty books, he was recognized in his own lifetime as the mujaddid, or reviver of religion, of his century, and he built his career in Timbuktu as a teacher and jurist of Islamic law within the Maliki legal tradition that dominated West African Islamic scholarship. His legal rulings on the Trans-Saharan slave trade addressed the boundaries of lawful enslavement under Islamic law, and he explicitly criticized the practice of treating Black Africans as inherently enslaveable, a position that placed him at odds with common racialized justifications for the trade in his region. After the Moroccan Saadi dynasty's invasion and conquest of the Songhai Empire in 1591, Ahmad Baba was deported to Morocco in 1594 and lived in Fez as an exile until 1608, continuing to teach and write during this period before eventually returning home. His surviving legal and biographical writings remain among the most important primary sources for the history of West African Islamic scholarship, particularly for reconstructing the career of the earlier scholar al-Maghili and the generation of jurists who followed him.
