What is instant customary international law, and how is it linked to Bin Cheng?
A theory Bin Cheng invented, holding that opinio juris alone can create a new customary rule overnight.
Bin Cheng invented the theory of instant customary international law. He developed it in the 1960s, during the Cold War, while investigating United Nations General Assembly resolutions on the legal principles governing outer space. The theory states that opinio juris is the only necessary element for creating a new rule of customary international law, so such a rule may arise overnight as long as member states of the international community do not reject opinio juris about its existence. The theory has gained support over time.
