Radhabinod Pal

International and Supranational Court Judges

Radhabinod Pal (27 January 1886 to 10 January 1967) was a Bengali Indian jurist who served as a member of the United Nations International Law Commission from 1952 to 1966. He was one of three Asian judges appointed to the International Military Tribunal for the Far East, the Tokyo Trials of Japanese war crimes committed during the Second World War, and was the only judge on the tribunal to submit a judgment holding that all of the defendants were not guilty. The Yasukuni Shrine and the Kyoto Ryozen Gokoku Shrine in Japan both carry monuments dedicated to him.

FAQs

Why did Radhabinod Pal reject the verdicts of the Tokyo Tribunal?

He doubted the legal basis of the aggression and humanity charges and viewed the trial as victors' justice.

Pal rejected the legal validity of crimes against peace and crimes against humanity, which the tribunal had transposed from the Nuremberg trial, and he judged that the tribunal dispensed victors' justice. He also rejected the prosecution's claim of a conspiracy within the Japanese ruling class to wage war from 1928, and he set Japanese actions within the wider history of British, French and Dutch colonialism in Asia. He was not an apologist for Japan: he believed the Japanese had committed war crimes and atrocities, such as the Nanjing Massacre of 1937, and thought those acts should have been charged under the Class B and C categories of conventional war crimes.
