Gordon Hewart, 1st Viscount Hewart

Common Law Founders and Commentators

Gordon Hewart, 1st Viscount Hewart (7 January 1870 to 5 May 1943) was a British politician and judge who served as Solicitor General from 1916 to 1919, Attorney General from 1919 to 1922, and Lord Chief Justice of England from 1922 to 1940, while sitting as Member of Parliament for Leicester and then Leicester East. He is remembered for articulating the principle that justice must not only be done but must also be seen to be done, and in 1929 he published The New Despotism, arguing that the growth of executive power was undermining the rule of law in Britain. In 1931 he quashed a murder conviction on the grounds that it could not be supported by the evidence, overruling the jury's verdict. He also took part in drafting the Constitution of the Irish Free State in May 1922, was raised to the peerage as Baron Hewart in 1922, and was created Viscount Hewart on his retirement in 1940.
