Zaleucus

Ancient and Roman Law Jurists

Zaleucus was a Greek lawgiver of Epizephyrian Locris in Magna Graecia, active in the seventh century BCE, remembered as the presumed author of the first written law code among the Greek city-states. According to the Suda, he began life as a shepherd and a slave before receiving an education and becoming a lawmaker, though some ancient sources instead identify him as a Pythagorean philosopher, and others place him before Pythagoras entirely or deny that he existed as a historical person at all, attributing his laws to divine origin instead. His Locrian code, the original text of which does not survive, is known through later references describing strict social regulation, including restrictions on women's movement, jewelry and dress based on marital status, a prohibition on drinking undiluted wine except for medical purposes, and severe penalties for adultery. The code's best known story holds that when his own son was convicted of adultery under a law that prescribed blinding as the penalty, Zaleucus submitted to the loss of one of his own eyes in his son's place rather than exempt him from the law's full punishment, a story later authors used to illustrate his commitment to applying his own laws impartially. Ancient sources also credit him with a distinctive procedural safeguard against reckless lawmaking, requiring anyone proposing a change to an existing law to appear before the citizens' council wearing a noose around their neck, to be tightened by execution if the council rejected the proposed change.
