In many common law jurisdictions, including England and Wales, Ireland, Canada, Hong Kong, India, Australia, New Zealand, Malaysia, and Singapore, an indictable offence is one that can be tried only on an indictment, following either a preliminary hearing to determine whether there is a prima facie case to answer or referral to a grand jury, in contrast to a summary offence tried without such a process. The United States uses the comparable category of felony, which for federal crimes likewise requires an indictment, while Scotland, as a hybrid common law jurisdiction, instead has the procurator fiscal bring solemn proceedings before a jury for serious crimes.
