The Federal High Court of Somalia is, under article 108 of the 2012 Constitution, the highest court at the Federal Government level, in a national court structure of three levels made up of the Constitutional Court, the Federal Government level courts and the Federal Member State level courts, the highest court at member state level being the Federal Member State High Court. The Constitutional Court is the final authority in constitutional matters and has sole jurisdiction over interpretation of the Constitution that has not arisen out of court litigation. The Chief Judge of the Federal High Court sits on the nine member Judicial Service Commission, and the World Factbook archive says judges are appointed by the president on that Commission proposal.
