Ius in Re

Ius in re, also written jus in re and usually translated as a real right or right in rem, is the civil law counterpart to the common law idea of a property interest: a right that attaches to a thing itself and can be asserted against the whole world, rather than a right that can only be enforced against one particular person. The strongest form is jus in re propria, full ownership or dominium, which carries the complete bundle of enjoyment and control over the thing. Beneath that sits jus in re aliena, meaning a right in someone else's thing, an encumbrance that lets a person use, secure a debt against, or draw income from property that another party still owns outright. Civil law systems built a whole family of these lesser real rights on top of ownership, including servitudes that burden one property for the benefit of another, usufruct and emphyteusis that grant long-term use or enjoyment without transferring title, hypothec as a non-possessory security interest, and rentcharge as a recurring payment obligation tied to the land itself. This atlas uses Ius in Re as the umbrella concept anchoring civil law property doctrines such as usufruct, emphyteusis, hypothec, servitude in civil law and rentcharge, distinguishing them from the English estate-in-land family that organizes common law property instead.
