Italian Code of Criminal Procedure

The Italian Code of Criminal Procedure sets out the rules governing criminal procedure in every court in Italy. The current code, the fourth Italy has adopted since unification, was enacted in 1988, replacing a 1930 code enacted under the Fascist government that had established a purely inquisitorial system. The 1988 code moved Italian criminal procedure toward a hybrid model, described as falling between the inquisitorial and adversarial systems, after nearly sixty years under the earlier framework.
