Rodolfo Sacco was an Italian legal scholar, born in 1923 and died in 2022, who spent his career as a professor at the University of Turin and became one of Europe's most influential comparative lawyers. He reshaped the field with his theory of legal formants, the distinct sources such as statute, judicial doctrine and scholarly commentary that together make up a legal rule, and of cryptotypes, the implicit assumptions a legal system carries that formal analysis alone does not capture. His 1979 introduction to comparative law and legal epistemology was translated into six languages, and he served as president of the Latin Group of the International Academy of Comparative Law and of the International Association of Legal Science.

What did Rodolfo Sacco mean by legal formants?
Legal formants are the several sources of a legal rule, such as scholarship and judicial decisions as well as statute.
Sacco used the term legal formants for the different elements that together make up a legal system, and he borrowed the word from phonetics. They include the formulations of scholars and the decisions of judges, not only the text of statutes. He also described some of these elements as cryptotypes, which are rules that people follow continually without being aware of them or being able to formulate them well. This is why his approach to comparative law looks past the written rule to the sources that actually shape it.
