Emilio Betti

Civil Law Scholars and Codifiers

Emilio Betti was an Italian jurist and legal theorist, born in 1890 in Camerino and died in 1968, who helped draft Italy's 1942 civil code and became best known for his contributions to the theory of interpretation. Arguing against Hans-Georg Gadamer's hermeneutic philosophy, Betti held that an interpreter's task is to reconstruct what an author originally intended, a position that influenced the American theorist E. D. Hirsch. He supported fascism after the First World War, was arrested in 1944, and was cleared of the resulting charges in 1945.

FAQs

Why was Emilio Betti arrested in 1944?

He was arrested for his earlier intellectual support of fascism and absolved in August 1945.

Betti was arrested in Camerino in 1944 because of his intellectual support of fascism between the end of the First World War and the beginning of the 1920s. He remained in prison for about a month, as decided by the Comitato di Liberazione Nazionale. In August 1945 he was brought before the court and absolved of every accusation.
