Charles Aubry (1803-1883) was a French legal scholar and magistrate who taught law at Strasbourg from 1833 to 1871 before serving as a judge on France's Court of Cassation from 1872 to 1878. With Charles Frederic Rau he wrote the Cours de droit civil francais (1839-46), the first comprehensive systematic treatment of French civil law to depart from the article-by-article structure of the Code civil, drawing on German legal concepts and remaining in print through a seventh edition issued in the 1960s and 1970s.

What made the Aubry and Rau treatise different from earlier French civil law books?
It presented civil law by subject rather than article by article through the Code civil.
Charles Aubry and Charles Frédéric Rau did not follow the Code civil article by article. Their Cours de droit civil français presented French civil law by subject matter instead, an approach drawn from German legal thinking, since the work began as an adaptation of a German treatise. A French legal history account notes that the authors were the first to present civil law in this way, and that their authority became so great that merely citing them was said to persuade a judge.
