Civil Code of Romania

The Civil Code of Romania, commonly called the New Civil Code and enacted as Law no. 287/2009, is the basic source of civil law in Romania. Parliament adopted it on July 17, 2009, and it took effect on October 1, 2011, replacing the 1865 Civil Code, the 1887 Commercial Code, and the 1954 Family Code with a single unified text. It follows a monist approach that places commercial law provisions inside the general civil code rather than a separate commercial code, and it covers personhood, family relations, property, inheritance, contractual obligations, statutes of limitations, and private international law. Its drafters drew primarily on the Swiss Civil Code and the Civil Code of Quebec as part of Romania's broader legal reform following its accession to the European Union.
